We want to bring your attention to a new law that went into effect

January 1. The law (Civil Code 4041) requires an annual solicitation of owner information. CFM will manage this responsibility for all of our clients as part of our service to your Association! Please read the full article below.

Civil Code 4041 – Member Contact Info

This new law requires the association to solicit information annually from each owner, and enter the data into its books and records at least 30 days prior to making its own required disclosure under Civil Code 5300 (annual budget report). The solicitation shall request the address(es) to which notices are to be delivered, an alternate or secondary address to which notices are to be delivered, the name and address of the owner’s legal representative including any person with power of attorney, and whether the separate interest is owner-occupied, rented out, developed but vacant, or undeveloped land. Currently, the law states if an owner fails to respond, the property address shall be deemed to be the address to which notices are to be delivered. However, there is an amendment currently being proposed (Choi, AB 1412) which would state the last address provided by the owner will be used in the event they do not mail back the solicitation. There is no opposition to this amendment in the legislature and we believe it will pass which is a good thing!
